Nojo — Terms of Service

These Terms of Service ("Terms") are a contract between you and JC Labs LLC ("Nojo," "we," "us") governing your use of the Nojo mobile app and the getnojo.app website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. What Nojo is

Nojo is a platform for university Greek-life organizations that replaces physical event wristbands with digital passes. Chapters manage events, members claim passes, and event staff check attendees in at the door. Nojo provides the software; chapters and their members are responsible for their own events and conduct.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Service. By using it, you confirm you meet this requirement and that the information you provide is accurate.

3. Accounts and phone-based login

  • Your mobile phone number is your login credential. You're responsible for keeping access to that number secure and for activity under your account.
  • You agree to receive one-time passcodes and transactional messages as described in the Privacy Policy and the SMS consent notice shown when you provide your number.
  • Don't create an account for someone else, impersonate anyone, or share your login access.

SMS program terms. By providing your number and agreeing to the consent notice, you consent to receive automated account and event text messages from Nojo. Message frequency varies with your account and event activity. Message and data rates may apply. Reply STOP to cancel texts at any time (you may not be able to log in via SMS code while opted out); reply HELP or email help@getnojo.app for help. Consent to texts is not a condition of any purchase. Wireless carriers are not liable for delayed or undelivered messages. Your mobile opt-in information is never shared with third parties for marketing (see the Privacy Policy).

4. Chapter subscriptions and payment

  • Fraternity chapters pay a subscription to use Nojo; sorority chapters use it free. Pricing is shown at signup.
  • Subscriptions are billed every 6 months through Stripe. Your card on file is charged automatically at renewal unless you cancel first.
  • Cancellation: You can cancel anytime before renewal. Cancelling stops the next renewal only — access continues through the end of the current paid period. No refunds are issued once a billing period has started.
  • Founding-rate chapters keep their locked founding rate for as long as their subscription stays active, per the terms shown at signup.
  • Auto-renewal notice: Your subscription renews automatically every 6 months at the then-applicable rate for your chapter until you cancel. We send a renewal reminder before each charge. You can cancel anytime through Chapter tab → Chapter Settings → Manage Subscription, which stops future renewals.

5. Acceptable use

You agree not to:

  • Use the Service for anything illegal, or to facilitate underage drinking or other unlawful activity;
  • Misrepresent your identity, affiliation, or a guest's information;
  • Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service;
  • Use the Service to harass, harm, or endanger anyone;
  • Circumvent event access controls, transfer passes fraudulently, or misuse guest invitations.

We may suspend or terminate accounts or chapters that violate these Terms.

6. Events, passes, and safety

  • Nojo is an access-management tool. It does not operate, host, supervise, or provide security for any event. Chapters and their institutions are solely responsible for their events, including compliance with their university, their national organization, and applicable law.
  • Digital passes are for the event and person they're issued to. Passes may be invalidated or recalled by a hosting chapter or by us as described in the app.
  • Safety-related records (attendance, check-in, Sober assignments, invalidations) are retained as described in the Privacy Policy.

7. Your content

You keep ownership of the information and photos you upload. You grant Nojo a limited license to use that content solely to operate and provide the Service (for example, showing your photo on your pass and roster). You're responsible for having the right to upload anything you provide.

8. Intellectual property

The Service, including the Nojo name, logo, and software, belongs to us and is protected by law. These Terms don't give you any rights to our branding or software beyond using the Service as intended.

9. Third-party services

The Service relies on third-party providers (including Supabase, Twilio, OneSignal, PostHog, Sentry, and Stripe). We're not responsible for those providers' own services, and their terms may also apply to you.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant that the Service will be uninterrupted, error-free, or secure. Nojo is not responsible for the conduct of any user, chapter, guest, or event, or for anything that happens at an event.

11. Limitation of liability

To the fullest extent permitted by law, Nojo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you or your chapter paid us in the 6 months before the claim.

12. Indemnification

You agree to defend and indemnify Nojo against claims and costs arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of others.

13. Termination

You may stop using the Service and delete your account at any time (see the Privacy Policy). We may suspend or end your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (payment owed, disclaimers, liability limits, indemnity, dispute terms) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Franklin County, Ohio, and you and Nojo consent to the personal jurisdiction of those courts.

15. App store terms

If you downloaded the app from Apple's App Store or Google Play, the store's own terms also apply. These Terms are between you and Nojo only — Apple and Google are not parties, have no responsibility for the app or its content, and have no obligation to provide support or maintenance for it. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Miscellaneous

  • Severability: If any part of these Terms is found unenforceable, the rest remains in full effect, and the unenforceable part will be modified to the minimum extent needed to make it enforceable.
  • Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and Nojo about the Service.
  • Assignment: You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
  • No waiver: Our not enforcing a provision isn't a waiver of it.
  • Notices: We may notify you through the app, by text, or via the contact information on your account.

17. Changes to these Terms

We may update these Terms. If we make material changes, we'll update the "Last updated" date and, where appropriate, notify you in the app. Continuing to use the Service after changes means you accept the updated Terms.
